The ruling by India’s highest court not to legalise same-sex marriage has been delivered, leaving the decision to the parliament. This decision aligned with the stance of Prime Minister Narendra Modi’s government, which asserts that such a pivotal issue should be handled by the legislature.
It was a unified decision by a five-judge bench, bringing a wave of disappointment to the LGBTQ community. This especially coming half a decade after the abolishment of the prohibition on gay sex.

The court’s refusal to legitimise same-sex marriage, left several LGBTQ individuals in tears, seeking comfort in one another’s presence.
Prime Minister Narendra Modi’s government, specifically the nationalist Bharatiya Janata Party (BJP), had previously expressed their opposition to the petitions on legalising same-sex marriage. They argued that the concept of same-sex marriage didn’t align with the traditional Indian family structure of a husband, wife, and children.

Chief Justice D.Y. Chandrachud pointed out the diverse thoughts among the judges, illustrating the complicated nature of the case. The judges were responsible for explaining the law, not forming it, a statement that underscored the boundaries of the legal system regarding this issue. Furthermore, Chandrachud dismissed the government’s notion that homosexuality is merely an “urban or elite” idea, highlighting its widespread relevance.
Role of the Panel
The court proposed creating a group to tackle the issues faced by same-sex couples. This suggestion is meant to include experts who understand the social, emotional, and psychological lives of LGBTQ people. Next, the group’s job will be crucial in looking at the rights and needs of this community, ensuring they’re addressed properly. So, this step is a move towards giving attention and care to the concerns of LGBTQ individuals.
Access to Services
The need for same-sex couples to have access to services akin to their heterosexual counterparts was emphasized. Proposals included the option for joint bank accounts and pensions, essential services that were currently inaccessible to the LGBTQ community.

The verdict left the LGBTQ community in shock and sadness. In other words, their hopes for legal recognition and equal rights were dashed. Despite the legalization of gay sex five years earlier, the refusal to recognize same-sex marriages highlighted a lingering inequality.

Compared to the West, Asia has been slow to embrace same-sex marriage. For instance, only Taiwan and Nepal have legalized it. This demonstrates the dominant conservative values in the region. This verdict underlined the significant gap between Eastern and Western perspectives on LGBTQ rights.
Activists’ Stand
LGBTQ activists believe it’s unfair to deny legal status to same-sex unions. They highlight a contradiction. In 2018, a law against gay sex was overturned, recognizing constitutional rights. However, legal support for same-sex unions is still missing. Despite this, the push for equality and recognition for the LGBTQ community in India goes on. The journey isn’t easy but the fight continues, aiming for a future where all are treated equally under the law.
