In South Korea, a court made history when it gave legal status to a couple who are both the same gender. Same-gender spouses can now receive health and other benefits without discrimination.
What is same-gender couple?
People of the same gender who are in a relationship are said to be in a same-gender relationship.
This is South Korea’s first legal recognition of same-gender marriage.
Key facts!
- After being refused spousal benefits, the complainant couple sued the National Health Insurance Service in 2021.
- But a lower court ruled with the insurance company because a common-law marriage between same-gender couples is illegal.
- The complaint’s lawyer called the Supreme Court’s judgement the “first legal acknowledgment of a same-gender partnership.”
- The couple says that they are happy not just for themselves but also for all LGBTQ couples and families in Korea.
- In addition, the high court also said that its most important duty is to protect the rights of minorities.
- But the National Health Insurance Service said it would appeal the decision to the Supreme Court.
- In South Korea, the Supreme Court is the highest court that hears cases about the law.
- Legal experts say that this is a big step towards marriage equality in South Korea.
