Parliament passes Delhi Bill

On Wednesday, the Rajya Sabha passed the Government of National Capital Territory of Delhi (Amendment) Bill. It was already passed by the Lok Sabha earlier.

The Delhi Bill

This controversial bill proposes to give more powers to Delhi’s Lieutenant Governor. The bill makes it clear that the term “government” in Delhi means the Lieutenant Governor. So, the Delhi government has to take his/her opinion before taking any action. As the Lieutenant Governor is appointed by the central government, it potentially gives more power to the centre over Delhi.

It is seen as a huge disadvantage to the elected government of Delhi. Additionally, there have also been clashes between the ruling Aam Aadmi Party (AAP) government and Delhi’s Lieutenant Governor over the years.

The bill was passed after two days of protests in the Rajya Sabha from opposition parties including AAP., The opposition repeatedly said it will destroy democracy.

The opposition said that the Delhi Bill is unconstitutional. They said that as per the Constitution, any change in the powers of the Delhi Government should be brought by way of a constitutional amendment only.

A constitutional amendment requires a two-thirds majority in parliament – not a simple majority. But this bill was passed by a simple majority.

On the other hand, the central government said that the Delhi Bill does not propose to bring any constitutional amendment. They said that it only wants to clear up certain unclear parts in the law.
